GO2KILI Terms of Service

GO2KILI, the trade name of GOTOKILI COMPANY LIMITED, a company registered in the United Republic of Tanzania. Throughout this document, references to “GO2KILI” mean GOTOKILI COMPANY LIMITED. By booking a climb, safari, or other adventure with us, you agree to be bound by these Terms and Conditions, which govern the relationship between you (the client) and GOTOKILI COMPANY LIMITED. These terms apply to all bookings made directly with us or through our authorized partners. Please read them carefully to understand your rights and responsibilities.

For the purposes of this document, the terms “tour,” “trip,” “climb,” “safari,” or “itinerary” refer to the travel arrangements booked with GO2KILI. The terms “client,” “guest,” “participant,” or “traveler” refer to you, the individual booking or participating in our services.

  1. Booking and Contract

1.1 Acceptance of Terms
By paying a deposit or any portion of the tour cost, you confirm your acceptance of these Terms and Conditions and our Booking, Cancellation, Changes, and Refund Policy on behalf of yourself and all members of your booking party. The person making the booking warrants they have the authority to enter into this contract for all participants.

1.2 Booking Confirmation
A booking is confirmed only upon receipt of the required deposit and written confirmation from GO2KILI. All bookings are subject to availability.

1.3 Accuracy of Information
You are responsible for providing accurate personal information, including full name, age, nationality, passport details, dietary requirements, and medical conditions, to facilitate tour arrangements and permit processing. GO2KILI is not liable for issues arising from inaccurate or incomplete information.

  1. Travel Insurance

2.1 Mandatory Insurance
All clients must have comprehensive travel insurance for the duration of their tour. Insurance must cover:

  • High-altitude trekking up to 6,000 meters (for Kilimanjaro climbs)
  • Emergency medical expenses, including evacuation and repatriation
  • Trip cancellation and curtailment
  • Personal injury and other relevant risks

Failure to provide proof of adequate insurance upon request may result in tour cancellation without refund, as per our cancellation policy.

2.2 Client Responsibility
You are responsible for ensuring your insurance policy meets the above requirements and for notifying your provider of the nature of your travel plans. GO2KILI will provide documentation to support insurance claims but is not responsible for the outcome of any claim.

  1. Medical and Fitness Disclosures

3.1 Fitness for Travel
Climbing Mount Kilimanjaro and participating in safaris involve physical exertion and inherent risks. It is your responsibility to assess your physical fitness and consult a licensed medical professional to determine your suitability for the tour. GO2KILI may provide general advice but recommends professional medical evaluation.

3.2 Medical Information
You must disclose any pre-existing medical conditions or special requirements (e.g., dietary, mobility) at least 30 days prior to your arrival. If requested, you must complete a medical form, which may require a licensed medical practitioner’s signature. Failure to provide accurate or complete medical information may result in tour cancellation without refund.

3.3 Medical Disqualification
GO2KILI reserves the right to decline or cancel your participation if, in our sole opinion, your medical condition poses a risk to yourself or others. If your condition deteriorates during the tour to a degree that endangers yourself or others, our chief guide may require you to descend or leave the tour, with no refund provided. You are responsible for any associated costs.

3.4 Dietary Requirements
We strive to accommodate dietary needs (e.g., vegetarian, vegan, gluten-free, halal) if notified 30 days in advance. However, we are not liable for failure to meet specialized needs unavailable in Tanzania, and no refunds will be issued in such cases.

  1. Baggage Limits and Liability

4.1 Baggage Limits

  • For Kilimanjaro climbs, luggage is limited to 15 kg per person (including personal gear and sleeping bags) to comply with porter regulations. Additional weight may incur extra fees or be refused.
  • For safaris, luggage is limited to 20 kg per person due to vehicle space constraints. Soft-sided bags are recommended.
  • Internal flights may impose stricter weight restrictions, detailed in your itinerary.

4.2 Baggage Responsibility
Baggage and personal effects are at your risk throughout the tour. GO2KILI is not liable for lost, delayed, or damaged luggage caused by third parties (e.g., airlines, transport providers). If your climbing gear is lost or delayed, we will provide necessary replacements from our rental shop free of charge for items you can verify were in your luggage. Other items are available for rent at standard rates.

4.3 Valuables
You are responsible for safeguarding valuables (e.g., money, gadgets, jewelry). GO2KILI is not liable for lost, stolen, or damaged personal property unless entrusted to our care in a secure company safe, which is available upon request and monitored by video surveillance.

4.4 Luggage Delivery Fees
If delayed luggage arrives after you, you are responsible for any delivery fees from Kilimanjaro International Airport to your hotel.

  1. Client Responsibilities During the Tour

5.1 Compliance with Instructions
You must follow all safety instructions and rules provided by GO2KILI guides and staff. The chief guide’s decisions regarding expedition arrangements, team management, itinerary, and safety are final. Failure to comply may result in your removal from the tour without refund, and you will bear any associated costs.

5.2 Respect for Local Regulations
You must comply with Tanzanian laws, national park rules, and cultural customs. Violations (e.g., littering, unauthorized activities) may result in fines, removal from the tour, or legal action, with no refund provided.

5.3 Responsible Behavior
You are expected to behave respectfully toward guides, porters, other clients, and local communities. Disruptive or harmful actions may lead to your removal from the tour without refund.

5.4 Environmental Stewardship
GO2KILI is committed to sustainable tourism and adheres to strict “leave-no-trace” protocols. You must respect these guidelines, including proper waste disposal and minimizing environmental impact. Violations may result in penalties or removal from the tour.

  1. Liability Disclaimers

6.1 Inherent Risks
You acknowledge that climbing Mount Kilimanjaro and participating in safaris involve inherent risks, including but not limited to high-altitude illness, wildlife encounters, physical exertion, and remote locations with limited medical facilities. You assume full responsibility for these risks and release GO2KILI from claims arising from losses, injuries, or death resulting from these inherent risks.

6.2 Third-Party Services
GO2KILI subcontracts certain services (e.g., accommodations, internal flights) to third parties. We are not liable for any delays, disruptions, or failures in performance by these providers. Their respective terms and conditions apply during their service provision.

6.3 Force Majeure
GO2KILI is not liable for delays, cancellations, or itinerary changes due to force majeure events, including but not limited to natural disasters, war, civil unrest, strikes, government actions, or extreme weather. In such cases, we will offer to reschedule your tour or provide a refund per our cancellation policy, less non-recoverable costs. We are not responsible for additional expenses (e.g., flights, visas) incurred by you.

6.4 General Limitation of Liability
GO2KILI, its employees, agents, and affiliates are not liable for any injury, loss, death, inconvenience, delay, or damage to property resulting from negligence or failure to act by third parties, or from events beyond our control, including those listed in Sections 6.1–6.3.

  1. Use of Personal Images and Video

7.1 Consent for Use
By participating in a GO2KILI tour, you consent to our employees, guides, or other participants capturing photos, videos, or other media that may include your image. GO2KILI and its partners may use this media for marketing, promotion, or advertising purposes without compensation to you.

7.2 Opt-Out Option
If you do not wish your image to be captured or used, you must inform your GO2KILI coordinator in writing at least 30 days prior to your tour. We will communicate this to our staff, but you are responsible for reminding guides during the tour, as other participants may still capture images.

  1. Equipment Damage or Loss

8.1 Client Liability
You are liable for any willful damage or destruction of GO2KILI property, including tents, safari vehicles, rented gear, or hotel furnishings. Compensation must be settled in Tanzania before your departure.

8.2 Rented Equipment
If you rent gear from GO2KILI, you are responsible for its care. Lost or damaged items will incur replacement or repair fees, payable upon completion of the tour.

8.3 Gear Inspection
Our chief guide may inspect your personal or rented equipment before the climb to ensure safety and compliance with park regulations. Non-compliant gear may be replaced at your expense.

  1. Travel Documents and Entry Requirements

9.1 Client Responsibility
You are responsible for obtaining all necessary travel documents, including a passport (valid for at least six months after entering Tanzania with at least two blank pages) and a Tanzanian visa. Online visa applications via the Tanzania Immigration Department are recommended.

9.2 Limited Advice
GO2KILI may provide general guidance on visas, vaccinations, and entry requirements, but this is not comprehensive or guaranteed. You must verify requirements with the Embassy of Tanzania or relevant authorities. We are not liable for denied entry or failure to meet entry requirements.

9.3 Consequences of Non-Compliance
If you are denied entry to Tanzania or fail to meet entry requirements, no refunds or rescheduling will be offered, as park fees and other expenses are prepaid.

  1. Accommodation

10.1 Hotel Accommodation

  • Open group tours include shared double or twin rooms. Solo travelers will be paired with a same-sex traveler unless a single supplement is requested and paid for at booking.
  • Private tour accommodations are arranged as agreed with your GO2KILI consultant.
  • If a specified hotel is unavailable, we will notify you and propose a comparable alternative before confirming your booking.

10.2 Tented Accommodation

  • Kilimanjaro climbs include shared tents (two travelers per tent). Solo travelers will be paired with a same-sex traveler unless a single supplement is requested and paid for, subject to park regulations (e.g., single tents are not permitted on the Marangu route).
  • All tented accommodations adhere to park standards and are inspected for safety.
  1. Vaccinations and Health Precautions

11.1 Client Responsibility
You must consult a licensed medical professional to determine required or recommended vaccinations (e.g., for malaria, yellow fever) and health precautions for travel to Tanzania. GO2KILI provides general guidance but is not liable for inaccuracies or omissions.

11.2 Medical Check
All climbers must undergo a medical check prior to the tour to confirm suitability for high-altitude trekking. You must verify that your medications do not interfere with altitude acclimatization (e.g., consult your doctor about Diamox compatibility).

  1. Complaints and Dispute Resolution

12.1 Reporting Issues
If you are dissatisfied with any aspect of your tour, notify your designated GO2KILI coordinator immediately. We will respond within 48 hours with a proposed solution.

12.2 Escalation
If the issue remains unresolved, contact our senior management team at info@go2kili.com. We will respond within 48 hours and work to address your concerns thoroughly.

12.3 Claims
For verifiable claims (e.g., missed services due to GO2KILI error), submit a written claim within 45 days of tour completion, supported by a statement from GO2KILI verifying the issue. No refunds will be issued for missed services due to client actions or third-party failures.

  1. Changes to Terms and Itinerary

13.1 Changes to Terms
GO2KILI reserves the right to update these Terms and Conditions at any time. Updates will be posted on our website, and continued use of our website or services constitutes acceptance of the revised terms.

13.2 Itinerary Changes by Client
Changes to your itinerary are subject to our Booking, Cancellation, Changes, and Refund Policy. Additional costs (e.g., for hotels, flights) must be covered by you.

13.3 Itinerary Changes by GO2KILI
We strive to operate tours as planned but may alter itineraries due to weather, safety concerns, or other factors beyond our control. We will notify you promptly and provide alternatives where possible. No refunds will be issued for minor changes that do not significantly impact the tour.

13.4 Third-Party Changes
GO2KILI is not liable for disruptions caused by third parties (e.g., flight delays, lodge policies). You or your insurance provider are responsible for any resulting costs.

  1. Governing Law

These Terms and Conditions are governed by the laws of the United Republic of Tanzania. Any disputes arising from your tour or these terms will be resolved in Tanzanian courts.
